¶1Supplementary affidavit filed today is taken on record.
¶2This is third bail application of the applicant.
¶3Heard learned counsel for the applicant and learned AGA for the State-respondent.
¶4The present bail application has been filed for enlarging the applicant on bail in Case Crime No. 208 of 2020, under Section 307 I.P.C., Police Station-Mohammadabad, District-Farrukhabad.
¶5This Court vide order dated 05.10.2023 had directed the District Judge, Farrukhabad to submit report about the status of trial.
¶6Additional Session Judge/Special Judge(Dacoity Affected Area), Farrukhabad submitted report dated 16.10.2023 according to which, P.W.-1 to P.W.-4 have been examined and there is likelihood of completion of trial in six months.
¶5On being confronted by the Court, learned counsel for the applicant except the pendency of trial, could not establish any new ground for enlarging the applicant on bail.
¶6Learned AGA has vehemently opposed the third bail application and submitted that applicant is habitual offender and indulged in so many criminal activities, therefore, no case is made out for enlarging the applicant on bail.
¶7Considering the facts and circumstances of the case, the gravity of the offence, the nature of accusations, severity of punishment in case of conviction and criminal history 19 cases, there does not appear any new good ground to release the applicant on bail.
¶8Accordingly, the third bail application is rejected.
¶9Keeping in view that the applicant is in jail since 19.07.2020, the trial court is directed to make all possible efforts to conclude the trial expeditiously, if possible, within a period of six months from the date of production of certified copy of this order.
