¶1Sri Vijai Kumar Tripathi, learned counsel for the petitioner and Sri G.P. Singh, learned A.G.A. for the State-respondents are present.

¶2This writ petition has been filed for quashing the impugned First Information Report dated 25.02.2023 in Case Crime No. 0142 of 2023 under Sections 419, 420, 467, 468, 471, 147, 504, 506, 406, 148 I.P.C., Police Station Pipraich, District Gorakhpur.

¶3Learned A.G.A. for the State-respondents has pointed out that the charge-sheet no. 17 of 2023 has been filed on 01.10.2023 in the present case against four accused persons, namely, Mahendra Nishad, Durgawati Devi, Raju Pandey and Vijay Kumar whereas the investigation is pending against the petitioners. He submits that the charge-sheet cannot be quashed in part and as such, the cause for filing present writ petition no more survives.
