¶1Heard counsel for the petitioner, learned standing counsel for the State respondents and Sri Tushar Kant for Union of India.

¶2The land of the petitioner was allegedly acquired under the provisions of National Highways Act, 1956. There is an award of Competent Authority dated 31.8.2022 (amended award dated

30.9.2022) in respect of the subject land. The N.H.A.I. challenged the same before Arbitrator. The Arbitrator has rejected the challenge advanced by N.H.A.I. by order-award dated 20.3.2023.

¶3The prayer made in the instant petition is for a direction to respondents no.2, 3 & 4 to pay compensation amount alongwith interest to the petitioners in pursuance of the aforesaid award.

¶4Counsel for the petitioner submits that the petitioner has filed application before the Competent Authority on 4.10.2023 but the money has not been released so far.

¶5Learned counsel for the respondents submit that the issue has to be examined by the Competent Authority.

¶6Accordingly, the petition is disposed of with direction to the Competent Authority (respondent no.4) to pass speaking order on the representation of the petitioner dated 4.10.2023 (Annexure-4) within eight weeks from the date of communication of the instant order alongwith photo copy of the application.
