¶1Instructions has been filed today are taken on record.

¶2Heard learned counsel for the parties and perused the record.

¶3This writ petition has been filed for following relief: "i) Issue a writ, order, or direction in the nature of mandamus commanding to the respondent no. 3/Sub Divisional Magistrate Handia Allahabad to compliance the order dated 28.07.2004 (Annexure No.3) passed by respondent no. 2/Addition Commissioner 1st Prayagraj Division Prayagraj in revision no. 122 of 2004 (Brijmohan Vs State of U.P. and others) under section 219 of U.P. Revenue code within stipulated period."

¶4Learned Standing Counsel has stated that proceedings for preparation of real time khatauni are being undertaken in the village concerned and therefore, the aforesaid revenue village has been blocked. The moment real time khatauni will be prepared, the proceedings for amaldaramad will be taken in accordance with law.

¶5In view of the statement made by learned Standing Counsel on the basis of instructions received, I am of the view that no order is required to be passed.

¶6However, in case, the undertaking as given, is not complied with, the petitioner is at liberty to approach this Court again.
