Heard advocate appearing for the petitioner. This petition has been filed with the following prayer: "i) direct the trial court to decide the case No. 1039 of 1990 ( Ramraj Vs. Ghirrao ) within stipulated period which is pending before the court of Civil Judge (Junior Division)- Second, Jaunpur (Annexure No.1 to this petition)." It is contended that the aforesaid suit was filed seeking injunction against the eviction from the suit property and other relief. It is stated that the suit was filed in the year 1990 and since then it is pending and the defendants are using delaying tactics. Pursuant to the order dated 18.8.2023, a report was sought from the District Judge, in which it has been stated that the matter is now placed before the Additional Civil Judge (JD)-II/Judicial Magistrate, Jaunpur. The report of Judicial Officer dated 24.8.2023 has also been perused by me. Though, this Court is well aware of the work pressure under which the Judicial officers are functioning, however, given the fact that the suit is pending since the year 1990, the trial court is required to endeavour to proceed to consider and decide the aforesaid suit without granting any unnecessary adjournment to either of the parties provided there is no legal impediment.
