¶1Heard learned counsel for the petitioner, learned Sanding Counsel for the State respondents and perused the record.

¶2This writ petition has been filed for the following relief:- "(i). Issue a writ, order or direction in the nature of mandamus directing to the respondent no.2 shall take appropriate action for create hindrance in the public pathway and in this regard the application dated 12.07.2023 is still pending".

¶3Learned Standing Counsel has raised a preliminary objection that the petitioner has a remedy of filing an application under Section 26 of the U.P. Revenue Code, 2006.

¶4In view of the above, I am not inclined to entertain the instant petition.

¶5In case, the petitioner moves an application under Section 26 of the U.P. Revenue Code, 2006, the same may be considered and decided expeditiously within a period of three months from the date of the filling of the application along with copy of this order.
