Court No. - 43 Case :- CRIMINAL MISC. WRIT PETITION No. - 17269 of 2023 Petitioner :- Firoz Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Chandra Bhushan Prasad Counsel for Respondent :- G.A. Hon'ble Anjani Kumar Mishra,J. Hon'ble Arun Kumar Singh Deshwal,J.
¶1Heard learned counsel for the petitioner and learned A.G.A. for the State.
¶2The instant writ petition seeks quashing of the FIR dated 28.02.2023 giving rise to Case Crime No.36 of 2023, under Section-307 I.P.C., Police Station-Chhatta, District-Agra.
¶3The impugned FIR is one u/s 307 IPC. Learned AGA states that the victim has suffered multiple incised wounds in her abdomen as it is clear from the injury report received along with the instructions.
¶4In our considered opinion, the injury report tends to fortify the allegations that have been made in the impugned FIR. Moreover, it contains the ingredients of a cognizable offence. The first information report, therefore, cannot be quashed.
¶5The petition is, accordingly, dismissed. Order Date :- 3.11.2023 S.Chaurasia High Court of Judicature at Allahabad
