In case of breach of any of the above conditions, the trial court will be at liberty to cancel the bail. The trial Court is directed to expedite the trial of the present case and conclude the same as expeditiously as possible, keeping in view the law laid down by the Apex Court in the case of Alakh Alok Srivastava Vs. Union of India and another reported in AIR 2018 (SC) 2440, if there is no legal impediment. Order Date :- 13.4.2022 "
¶4Present application for cancellation of bail has been filed in A cavalier fashion There is no document in the affidavit filed in support of present bail cancellation application of accused opposite party-2 that either he has jumped or has terrorized the witnesses. Apart from above, the Court finds that the prosecutrix has solemnized marriage with accused opposite party-2 as is clearly evident from the recital contained in the bail order passed in favour of accused-opposite party-2. No material has been brought on record to the effect that any proceeding has been initiated by the prosecutrix for declaration of her marriage with accused/opposite party-2 as void.
¶5Having heard the learned counsel for applicant, the learned A.G.A. for State, the learned counsel representing accused/opposite party-2 and upon consideration of material brought on record, this Court finds that upto this stage no such incriminating material has emerged on the basis of which it can be definitely concluded that accused/opposite party-2 has either jumped the bail or he has been terrorizing the witnesses. In view of above, no good or sufficient ground has emerged to cancel the bail granted to accused/opposite party-2.
¶6As a result, present bail cancellation application is misconceived and is liable to be rejected.
¶7It is accordingly rejected. Order Date :- 3.11.2023 YK High Court of Judicature at Allahabad
