The present petition has been filed challenging the order dated 11.7.2019 passed by the Superintendent Engineer, Public Works Department, Ballia Circle, Ballia cancelling the tender submitted by the petitioner and asking the subordinate ofÏcer to proceed further after inviting fresh tenders from the eligible candidates. Supplementary counter afÏdavit has been filed by the State-respondents and the order dated 22.5.2019 passed by the Chief Engineer, Public Works Department has been annexed with the supplementary counter afÏdavit showing that the registration of the petitioner as contractor has been cancelled. In view of the aforesaid, no purpose would be served to consider the writ petition on merits. Even if the writ petition is allowed, the petitioner will not be able to prosecute his contract. The petition has become infructuous and is dismissed as such. Shri Dilip Kumar Kesharwani, Additional Chief Standing Counsel is present.
