¶1Sri Avdhesh Kumar, learned counsel has filed his vakalatnama on behalf of the alleged corpus Smt.Iqra Shahid (petitioner no.1). The same is taken on record.

¶2Heard Sri Vijay Prakash Singh Kushwaha, learned counsel for the petitioner no.2, Sri Avdhesh Kumar, learned counsel for the corpus (petitioner no.1) and learned A.G.A. for the State.

¶3This petition has been filed on the allegations that petitioner no.1 is wife of petitioner no.2 and has been illegally detained by members of her family.

¶4It is submitted by newly engaged counsel for the petitioner no.1 that Criminal Misc.Writ Petition No.15729 of 2023 has been filed which pertains to case crime no.138 of 2023, under Sections 498-A, 504 and 506 I.P.C. and Section 3/4 Dowry Prohibition Act and 3/4 of Muslim Women (Protection of Rights on Marriage) Act lodged by petitioner no.1 herself. It is further submitted that matter is presently being dealt with by the Mediation Centre, Allahabad High Court. It is further submitted that as petitioner no.1 is voluntarily staying with parents in the background of strained relations with her husband and that she is not under any illegal detention, restraint or pressure, hence, no cause of action lies under Habeas Corpus Writ Petition.

¶5In the above circumstances, the petitioner no.2 seeks not to press this habeas corpus writ petition, hence, it is dismissed as not pressed. Order Date :- 3.11.2023 Asha High Court of Judicature at Allahabad
