Court No. - 10 Case :- WRIT - C No. - 37066 of 2023 Petitioner :- C/M Bramhdutt Dwivedi Prabha Dwivedi Degree College And Another Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Raghvendra Pratap Counsel for Respondent :- C.S.C.,Avneesh Tripathi Hon'ble Kshitij Shailendra,J.
¶1Heard Shri Raghvendra Pratap, learned counsel for the petitioners, learned Standing Counsel for respondent No.1 and Shri Avneesh Tripathi, learned counsel for respondent Nos. 2 and 3.
¶2This writ petition has been filed by the Committee of Management Bramhdutt Dwivedi Prabha Dwivedi Degree College, Ramgarh, Chhawani, District Basti with a prayer that the respondents be directed to allot self-centre for girls-students in the upcoming Semester Examinations for B.A. degree in terms of certain Government Orders.
¶3Shri Avneesh Tripathi, learned counsel for the University submits that no examinations are going to be held in near future and, moreover, the petitioners have no locus to file the present writ petition as they are placing reliance upon certain applications moved by the girls-students, who are around 20 to 25 only and it is for the University to take a decision in the matter as and when the cause of action arises.
¶4After perusing the entire writ petition, I do not find that the petitioners have any direct interest in the matter.
¶5In case, certain girls-students are facing difficulties, at the time when the examinations are notified and they satisfy the Authority regarding their grievance, it is for the Authorities to take decision in their matters.
¶6The writ petition has been filed at a very premature stage by the Committee of Management and not by the students.
¶7The Court is not inclined to issue any direction in such matters.
¶8The writ petition is dismissed with the aforesaid observations. Order Date :- 3.11.2023 Sazia High Court of Judicature at Allahabad
