Judgment

Court No. - 72 Case :- CRIMINAL REVISION No. - 3071 of 2023 Revisionist :- Raju Singh Opposite Party :- State of U.P. and Another Counsel for Revisionist :- Santosh Kumar Gupta Counsel for Opposite Party :- G.A. Hon'ble Krishan Pahal,J.

¶1List has been revised.

¶2Heard Sri Vinod Kumar Yadav, Advocate holding brief of Sri Santosh Kumar Gupta, learned counsel for the revisionist and Sri Ramesh Chandra Gupta, learned A.G.A. for the State and perused the record.

¶3The present criminal revision has been filed assailing the order dated

31.03.2023 passed by Principal Judge, Family Court, Sambhal at Chandausi in Case No.104 of 2018, (Smt. Laxmi Devi and Another Vs. Raju Singh), u/s 125 of Cr.P.C., Police Station-Bahjoi, District-Sambhal whereby court concerned has awarded maintenance of Rs.10,000/- per month to the wife and Rs.5,000/- per month to his daughter from the date of order which has to be deposited by 10th of every month.

¶4Learned counsel for the revisionist has stated that the revisionist is simply an agriculturist and is a member of joint family, as such, he is unable to pay the said amount to his wife and daughter.

¶5Per contra, learned AGA has opposed the criminal revision on the ground that in the present scenario, Rs.15,000/- is a meagre amount and the said application for maintenance was pending since 2019 and four long years have passed to get it decided. Learned AGA has further stated that the wife and her daughter have been forced to lead a life of destitution and vagrancy due to the attitude of the revisionist, as such, the present criminal revision is liable to be dismissed.

¶6After hearing the parties and taking into consideration the fact that the said maintenance awarded by the court concerned seems to be reasonable, I do not find any ground to grant any relief to the revisionist. No interference, therefore, is called for.

¶7The present revision is found devoid of merits and is, accordingly, dismissed. (Justice Krishan Pahal) Order Date :- 3.11.2023 Siddhant High Court of Judicature at Allahabad
