¶1Heard learned counsel for the parties and perused the record.

¶2This writ petition has been filed for the following relief:- "(i) To issue a writ, order or direction in the nature of Mandamus directing the Respondent No.2/Tehsildar, Tehsil Tamkuhiraj, District Kushinagar to decide the representation dated 26.06.2021 & 04.09.2023 of the petitioner forthwith.

(ii) To issue a writ, order or direction in the nature of Mandamus directing the respondent no.2 to gave the possession to the petitioner over the land in question."

¶3The contention of learned counsel for the petitioner is that the petitioner has been grated abadi patta but has not been put in possession.

¶4Learned Standing Counsel has raised a preliminary objection that the petitioner can file an application under Section 65 of the U.P. Revenue Code, 2006 in this regard.

¶5In view of the above, I am not inclined to interfere in the matter.

¶6However, it is provided that in case, petitioner moves an application under Section 65 of the U.P. Revenue Code, 2006, the same shall be decided and considered, expeditiously in accordance with law
