¶1Petitioners by way of this writ petition have prayed that a mandamus be issued to drop consolidation proceedings, i.e., to pass a notification under Section 6(1) of U.P. Consolidation of Holdings Act, 1953, however, as rightly pointed out by learned Standing Counsel such prayed is in the teeth of judgment passed by this Court in Agricultural and Industrial Syndicate Ltd. vs. State of U.P., 1976 RD 35.

¶2Learned counsel for petitioners submits that some of the respondents have approached this Court by way of filing Writ B No. 1715 of 2023 and this Court has disposed of writ petition with direction to decide application filed by respondents. Learned counsel submits that presently the matter is pending before Consolidation Commissioner.

¶3In aforesaid circumstances, this Court cannot go into merit of the case and the writ petition is disposed of with observation that if matter is pending, the Consolidation Commissioner will take appropriate decision expeditiously. Order Date :- 6.11.2023 AK High Court of Judicature at Allahabad
