¶1This petition has been filed with a grievance that though the petitioner fulfills requisite criteria for its inclusion on the grant-in-aid list of the State of U.P., its request contained in the representation dated 28.09.2022 is pending before the respondent No.1, i.e. State of U.P. through Principal Secretary, Department of Social Welfare, Lucknow and no decision has been taken.

¶2Learned Standing Counsel submits that such a decision consumes a lot of time and the Institution concerned has to satisfy various criteria. However, he does not dispute that the State Government is duty bound to consider the request of any Institution in the light of prevailing policy/ guidelines/ Rules/ Regulations or statutory provisions.

¶3Considering the nature of the relief made in the present petition, this petition is disposed of directing the respondent No.1, i.e. State of U.P. through Principal Secretary, Department of Social Welfare, Lucknow to consider the representation of the petitioner dated

28.09.2022 and take a decision thereon after calling for report and record from the remaining respondents No. 2 and 3.

¶4Such a decision shall be taken on or before 31.01.2024 in accordance with law.

¶5It is made clear that this Court has not examined the merits of the claim of the petitioner and it is for the respondent No.1 to take a lawful decision in the matter. Order Date :- 6.11.2023 Sazia High Court of Judicature at Allahabad
