¶1The land of the petitioner was acquired under the provisions of National Highways Act, 1956. The award was made in respect of the acquired land on

09.10.2020. It seems that compensation was not determined for the boundary wall standing over it.

¶2The Competent Authority by letter dated 29.07.2022 addressed to Project Director, PIU, Rudrapur requested for amended valuation report being supplied to him within a week. In pursuance thereof, the Project Director, NHAI by letter dated

7.11.2022 apprised the Competent Authority of the amount to be paid to the petitioner in respect of the structure standing over the acquired land.

¶3Grievance of the petitioner is that no action has been taken thereafter by respondent No. 2.

¶4Shri Rajiv Gupta, learned Addl. Chief Standing Counsel very fairly states that respondent No. 2 will examine the claim of the petitioner and will pass appropriate order.

¶5Accordingly, without expressing any opinion on merits, the writ petition is disposed of with a direction to respondent No. 2 to take necessary decision in pursuance of the report called for by him vide order dated 28.7.2022 within a period of eight weeks from the date of communication of the instant order.
