Instructions filed today be kept on record. This writ petition has been filed challenging the demand notice dated 15.12.2022. Sri Mata Prasad, Advocate holding brief of Sri Baleshwar Chaturvedi, learned counsel appearing for Electricity Department states that the petitioner by the communication dated 3.10.2023 had been directed to appear on 16.10.2023 and that the earlier demand notice had been put in abeyance. This communication dated 3.10.2023 has been brought on record and has also been served on the learned counsel for petitioner. Learned counsel for petitioner states that notice/communication dated 3.10.2023 was not served upon the petitioner, therefore, he could not appear on 16.10.2023. Under such circumstances, we provide that the petitioner may appear before the Electricity Department on 20.11.2023 and thereafter, after giving an opportunity of hearing to the petitioner, final assessment order shall be passed within a period of two months. For a period of two months or till any final decision is taken, whichever is earlier, no coercive action shall be taken against the petitioner.
