¶1Heard learned counsel for applicant and learned AGA for State.

¶2This is third bail application filed by applicant-Sandeep Yadav in Case Crime No. 79 of 2019, under Sections 376-D, 506 IPC, Police Station Saraimeer, District Azamgarh. First and Second bail applications were rejected on 16.03.2023 and

16.08.2023 respectively.

¶3It is not in dispute that statement of victim has been recorded and she has been cross-examined at length. However, she remained consistent atleast that applicant has committed offence for which he has been charged.

¶4Learned counsel for applicant submits that co-accused has already been enlarged on bail, however, since bail application of co-accused has been allowed being juvenile, therefore, no benefit can be granted to applicant, who is admittedly major.

¶5At this stage, learned counsel for applicant submits that Trial Court may be directed to expedite the trial.

¶6In aforesaid circumstances, the application is disposed of with observation that Trial Court will take all endeavour to conclude trial expeditiously, preferably within a period of six month from today, if there is no legal impediment.
