¶1Heard Sri S.P. Gangwar, learned counsel for the petitioner and learned Additional Chief Standing Counsel for the State-respondents.

¶2This writ petition is preferred for a mandamus directing the respondent No.2 to decide the representation of the petitioner dated 09.12.2022 expeditiously.

¶3Grievance of the petitioner is that his father Ram Bahadur has executed a gift deed in favour of one lady on 08.07.2022.

¶4Learned Additional Chief Standing Counsel raises an objection regarding maintainability of the writ petition on the ground that once the instrument is in existence, the same can be declared as null and void by a judgment only in an appropriate suit proceeding.

¶5Considering the facts and circumstances of the case, we are not inclined to entertain the writ petition. Needless to say, it is always open to the petitioner to challenge the alleged gift deed dated 08.07.2022 before the competent civil court.
