The only request of the petitioner is to issue an order and direction to the court concerned to decide the Complaint Case No. 1090 of 2019 (Pradeep Yadav Vs. Sanjay Kumar) under section 138 N.I. Act, within stipulated period. It is submitted that the petitioner-complainant filed the above case in 2019 and the same is yet to be finally decided. Section 143(3) provides that every trial under this section shall be conducted as expeditiously as possibly and an endeavour shall be made to conclude the trial within six months from the date of the filing of the complaint. In view of the above legal provisions, the learned trial court is directed to expedite the matter and to decide the case keeping in view the above provisions of law. It is provided that the complainant shall fully cooperate in the trial and shall diligently play its role in accordance with law. Accordingly, this petition is disposed of.
