¶4Learned counsel for the applicant argued that the applicant is jeth of the deceased and he has been falsely implicated in the present case. Medical College, Agra the final opinion regarding cause of death was opined as "due to compression of neck structure by throttling and ligature strangulation. (Homicidal in Nature)". It is argued that hyoid bone of the deceased was not found to be fractured. It is argued that the applicant was living separately from the deceased and her husband at a distance of about 5 kilometers, para-15 of the affidavit and annexure no.8 being electricity bill in the name of wife of the applicant have been placed before the Court to buttress the said arguments. The applicant is having no criminal history as stated in para-24 of the affidavit and is in jail since 21.6.2023.
