Court No. - 81 Case :- MATTERS UNDER ARTICLE 227 No. - 9395 of 2022 Petitioner :- Rangesh Kumar Respondent :- State of U.P. and Another Counsel for Petitioner :- Vijendra Kumar Mishra Counsel for Respondent :- G.A. Hon'ble Mrs. Jyotsna Sharma,J.

¶1Heard Sri Vijendra Kumar Mishra, learned counsel for the petitioner and learned A.G.A. for the State.

¶2The only prayer of the petitioner is that the divorce petition pending before the Principal Judge, Family Court, in Case No. 1427 of 2018, may be decided in expeditious manner, within stipulated period.

¶3Admittedly, the petitioner filed the case under section 9 of Hindu Marriage Act in 2018. Later on, it has been coverted into one under section 13 of Hindu Marriage Act, by an order dated 14.04.2022. It is submitted by the petitioner that long pendency of the case, especially, that of matrimonial case, is causing him mental trauma and that his fundamental right for speedy justice is being infringed.

¶4In view of the above submission, the court concerned is directed to expedite the hearing of the Case No. 1427 of 2018 (Rengesh Kumar Vs. Shreya), provided the petitioner cooperates and is diligent in prosecuting the same.

¶5Accordingly the petition under Article 227 is finally disposed of. Order Date :- 6.11.2023 Sumit Kumar High Court of Judicature at Allahabad
