Shri Yogesh Kumar Saxena who appears for the respondent No.6, Shri Rajiv Kumar Katihar, leacturer in economics has produced before this Court a document dated 09.08.2023 under the signature of District Inspector of Schools address to the manager according to him is in his favour. Shri Suyash Pandey, learned counsel for the writ petitioners submits that the present writ petition be dismissed as withdrawn with liberty to file fresh, challenging the order which the respondent No. 6 seeks to rely upon. To such a submission, learned counsel for the respondent No. 6 has no objection to the same. Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty. Whenever the fresh writ petition has been filed, a copy of the present writ petition be served upon Shri Yogesh Kumar Saxena who appears for the respondent No. 6. A copy of the order dated 09.08.2023 is kept on record and marked as Appendix-A. A copy of order dated 09.08.2023 be served upon the learned counsel for the writ petitioner.
