This writ petition has been filed against the Recovery Citation dated 02.08.2023 by which certain amount was being recovered by the Electricity Department. Upon filing of the writ petition, instructions have been obtained by the learned counsel for the Electricity Department and it has been stated the final assessment order has now been passed on 6th August, 2023 and that the petitioner is now being charged Rs.1,20,497/- for the electricity consumption and towards compounding charges in the criminal case, Rs.20,000/- was being charged. Since the final assessment order has now been passed, it has been submitted by the learned counsel for the Electricity Department that steps have been taken for the withdrawal of the earlier recovery certificate. Under such circumstances, no interference is warranted. The petitioner may take recourse to such action as may be available to him under the laws. The writ petition is accordingly disposed of.
