This instant application under Section 482 Cr.P.C. has been preferred with a prayer to quash the charge sheet dated 15.02.2023 and proceeding of Complaint Case No. 15097 of 2023 (State Vs. Lal Bahadur and others) arising out of N.C.R. No. 338 of 2022 dated 07.11.2022, under Section 427 I.P.C., Police Station Bhadohi, District Bhadohi, pending in the Court of learned Chief Judicial Magistrate, Bhadohi. At the outset, learned counsel for the applicants submits that on account of some defect in the application, the applicants do not want to press this application, therefore, the same may be dismissed as withdrawn with liberty to file fresh application. Learned A.G.A. for the State has no objection to such prayer. In view of the statement made by learned counsel for the applicant at the bar, the instant application is dismissed as not pressed with aforesaid liberty. Office is directed to return the certified copy of the documents to the learned counsel for applicants within three days after retaining xerox copy of the same to be kept on record as per law.
