Judgment
Court No. - 10 Case :- WRIT - C No. - 18583 of 2022 Petitioner :- Ananya ( Minor) Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Saroj Kumar Yadav,Anil Kumar Aditya,Nagendra Pratap Singh Counsel for Respondent :- C.S.C.,Jai Singh Hon'ble Kshitij Shailendra,J.
¶1Heard Shri Nagendra Pratap Singh, learned counsel for the petitioner, learned Standing Counsel for respondent No. 1 and Shri Jai Singh, learned counsel for respondent No. 4.
¶2There is some dispute regarding petitioner's admission in IInd year of Diploma in Pharmacy. Whereas the contention of learned counsel for the petitioner is that the Institution wrongfully restrained her from admission in IInd year of the said Course, the contention of Shri Jai Singh, learned counsel for the respondents is that the petitioner absented herself and, even otherwise, the entire Session has lapsed.
¶3This writ petition was filed in the year 2022 and by the end of 2023, this Court cannot grant a relief directing the respondents to take admission from retrospective effect.
¶4In this view of the matter, learned counsel for the petitioner has come up with the request that respondents may be directed to allow the petitioner to take admission in IInd year of Diploma in Pharmacy now. The petitioner may apply before the respondent Nos. 3 and 4 requesting admission in the ensuing Session of the concerned Course.
¶5In case, the petitioner fulfills the requirements and if seats are available, taking a sympathetic view of the matter, particularly that one Session has already lapsed, the concerned respondents shall take a decision in the matter by the end of December, 2023 and in case some guidelines are required from the University, the Institution shall obtain the same during this period itself, provided a certified copy of this order is served upon respondent Nos. 3 and 4 before 22.11.2023.
¶6With the aforesaid observations, the writ petition is disposed of. Order Date :- 6.11.2023 Sazia High Court of Judicature at Allahabad
