Counsel for Applicant :- Vidya Kant Tripathi Hon'ble Rohit Ranjan Agarwal,J. The writ Court on 04.10.2023 in Matters Under Article 227 No.10111 of 2023 had passed the following order:- "1. Shri Abhishek Bhushan has filed his vakalatnama on behalf of respondent.

¶2Heard Shri Vidya Kant Tripathi, learned counsel for the petitioner and Shri Abhishek Bhushan, learned counsel for the respondent.

¶3By means of the present writ petition the petitioner has assailed the order dated 09.08.2023 by which the application of petitioner under Order 21 Rule 97 has been rejected. The order impugned is treated to be decreed as provided under Order 21 Rule 103 of the C.P.C. and accordingly, the appeal shall lie against the said order.

¶4Consequently, the writ petition under Article 227 is dismissed, with the liberty to the petitioner to avail appropriate remedy available in law.

¶5Office is directed to return the certified copy of order impugned to the learned counsel for the petitioner after keeping the photocopy of the same on record." From the perusal of the aforesaid order, it is clear that the writ Court had dismissed the writ petition. As the writ petition was dismissed itself, present contempt application is misconceived and the same stands dismissed. Order Date :- 7.11.2023 SK Goswami High Court of Judicature at Allahabad
