Judgment
Court No. - 10 Case :- WRIT - C No. - 28068 of 2023 Petitioner :- Kailash Singh(Alias Ramkalesh) Respondent :- State Of U.P. And 7 Others Counsel for Petitioner :- J.P. Singh,Santosh Kr. Singh Paliwal Counsel for Respondent :- CSC Hon'ble Kshitij Shailendra,J.
¶1Heard Shri Santosh Kumar Singh Paliwal alongwith Shri J.P. Singh, learned counsel for the petitioner and learned Standing Counsel for the State.
¶2This petition has been filed seeking a direction for consideration of the petitioner's objection/application dated 28.06.2023 submitted before the Assistant Registrar, Firms, Societies and Chits, Azamgarh.
¶3I have perused the said application/objection which contains detailed facts, however, the prayer made is that the order dated
29.07.2016 has been wrongly/erroneously passed by the Assistant Registrar, therefore, the same be reviewed and defunct Committee be reconstituted after validating life members under Section 15 of the Societies Registration Act, 1860 (in short 'the Act, 1860').
¶4Since, the prayer also refers to the proceedings of Writ C No.15978 of 2016 (C/M Bhuvaal Smarak Shiksha Samiti And Another v. State of U.P. And 2 Others), I have perused the order dated 04.05.2016, which is a detailed interim order passed by this Court. It is contended that later on, the said writ petition was disposed off on 16.05.2016. I have also perused the order dated
06.03.2017 passed in Writ C No.42457 of 2016 (C/M Bhuvaal Smarak Shiksha Samiti Ghaghra And Another v. State of U.P. And 3 Others) alongwith Writ C No.61645 of 2016 (Smt. Krishnamati Devi And 4 Others v. Assistant Registrar And Another), which were filed challenging the order dated 29.07.2016 which is sought to be reviewed by means of the objections.
¶7This Court has already dismissed the said two writ petitions as withdrawn with liberty to the concerned petitioners to approach the Prescribed Authority under Section 25(1) of the Act, 1860.
¶8Once, the challenge made against order dated 29.07.2016 has been turned down by this court, as aforesaid, no direction can be issued to the Assistant Registrar to directly or indirectly review the order and, hence, mandamus as sought cannot be granted.
¶9The writ petition has no merit and is, accordingly, dismissed. Order Date :- 7.11.2023 Jyotsana High Court of Judicature at Allahabad
