¶1Heard counsel for the petitioner, learned standing counsel for the State respondents and Sri Vaibhav Tripathi for respondents no.3 & 5.

¶2The instant petition has been filed praying for a mandamus directing the State respondents to pay compensation to the petitioner in terms of amended award dated 19.09.2023 passed by Competent Authority under the provisions of the National Highways Act.

¶3Sri B.D. Pandey, counsel for the petitioner admits that the petitioner has not approached the Competent Authority for release of the compensation amount in terms of the amended award. He states that the petitioner will approach the said Authority and direction be issued to the Authority to consider the application of the petitioner as and when filed.

¶4Accordingly, without expressing any opinion on merits, the instant petition is disposed of with liberty to the petitioner to approach respondent no.4 for release of the compensation amount in terms of the amended award and in which event, he will take action in the matter in accordance with law.
