This writ petition has been filed under Section 227 of Constitution of India seeking direction upon Commercial Court, Gautam Buddh Nagar to decide stay application dated 20.09.2023 filed in Arbitration Application No. 74 of 2022 filed under Section 34 of Arbitration and Conciliation Act, 1996. The counsel for the petitioner has confined his prayer only to direction for deciding the stay application. As the prayer sought in the writ petition is only for the direction upon Commercial Court, Gautam Buddh Nagar to decide the stay application, notice is not being issued to respondent. In view of prayer so made, Commercial Court, Court No. 2, Gautam Buddh Nagar is hereby directed to take up stay application dated 20.09.2023 filed by petitioner and after hearing all the affected parties decide the same, expeditiously, preferably within a period of six weeks from the date of production of certified copy of this order.
