¶1Heard learned counsel for the applicant; Sri Shubham Maurya, Advocate holding brief of Sri Santosh Kumar Gupta, learned counsel for the informant and the learned A.G.A. for the State.

¶2The instant bail application has been filed on behalf of the applicant, Pappu @ Deena, with a prayer to release him on bail in Case Crime No. 278 of 2022, under Sections-147, 148, 149, 302, 201, 323, 506 IPC and Section 3(2)(5) of SC/ST Act and Section 3(1) of U.P. Gangster Act, Police Station-Bhadohi, District-Bhadohi.

¶3There is allegation against the applicant of committing the offence of forming unlawful assembly, murder, criminal intimidation, etc., after rioting.

¶4Counsel for the applicant submits that all the accused persons have been assigned general role.

¶5However, there is C.C.T.V footage which proves the implication of applicant in this case conclusively with definite and active role.

¶6This Court after hearing the learned counsels for the parties does not finds any ground for enlarging the applicant on bail at this stage.

¶7The bail application is accordingly, rejected.

¶8The trial court is directed to conclude the trial against the applicant as expeditiously as possible, preferable within a period of one year from the date of production of certified copy of this order. Order Date :- 7.11.2023 / Rohit High Court of Judicature at Allahabad
