Judgment
Court No. - 44 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 47386 of 2023 Applicant :- Awadesh @ Kuldeep Opposite Party :- State of U.P. Counsel for Applicant :- Ajay Vikram Yadav,Devendra Singh Counsel for Opposite Party :- G.A. Hon'ble Pankaj Bhatia,J.
¶1Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.
¶2It is argued by the Counsel for the applicant that an FIR was lodged against two vehicles as disclosed in the FIR. It is also alleged that the said two vehicles were not given the pass and the allegations of substantial injuries were also raised.
¶3It is further argued by the Counsel for the applicant that the applicant was not named in the FIR and the name of the applicant surfaced in the statement of the co-accused who have been enlarged on bail by this Court vide orders dated 03.02.2020 and
03.02.2020. The injury report on record also does not indicate any major injuries.
¶4Learned A.G.A. vehemently opposed the bail prayer.
¶5Considering the fact that the co-accused have been enlarged on bail and the applicant has no criminal antecedents, I am of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed.
¶6Let the applicant Awadesh @ Kuldeep be released on bail in FIR/ Case Crime No.617 of 2019, under Sections 307 IPC, Police Station Sirsaganj, District Firozabad on his furnishing personal bonds and two reliable sureties of Rs.25,000/- each to the satisfaction of the court concerned with the following conditions:
