¶1Heard Shri Nishith Tripathi, learned counsel for the applicants and learned A.G.A. for the State.

¶2By means of the present application under Section 483 Cr.P.C., the applicants have sought for a suitable direction to the learned Chief Judicial Magistrate, Chitrakoot to expedite Criminal Case No. 4322 of 2013 (State Vs. Vinod Yadav and others), arising out of Case Crime No. 27 of 2013, under Sections 380, 411 I.P.C., P.S. Rajapur, District Chitrakoot, within time stipulated by this Court.

¶3Learned counsel for the applicants submits that the instant case is pending trial since 03.06.2013 before the learned Chief Judicial Magistrate, Chitrakoot, and since then evidence has not been recorded because of the reason that the witnesses are not coming forward to depose in Court despite repeated orders passed by the trial court for summoning the witnesses.

¶4On perusal of the order-sheet, no plausible reason has transpired for non-appearance of the witnesses.

¶5In the light of the fact that the matter is pending since 2013 and no witness could be examined by the trial Court. The necessary steps be taken by the Court so that the case could be timely concluded. The applicants/ accused are facing trial since 2013 against their inherent rights to seek speedy justice.

¶6In the light of the fact that the Case No. 4322 of 2013 (State Vs. Vinod Yadav and others) is pending before Chief Judicial Magistrate, Chitrakoot is directed to consider and decide the aforesaid criminal case expeditiously on merits, in accordance with law.
