¶1Learned A.G.A. submits that in this matter the F.I.R. was lodged under section 406 IPC, but during investigation of the case it was converted into section 409 IPC.

¶2At this stage, learned counsel for the applicant submits that he does not want to press this application, therefore, the same may be dismissed as withdrawn with liberty to file fresh application u/s 438 Cr.P.C. as per law.

¶3Application u/s 438 Cr.P.C. is dismissed as withdrawn with liberty as prayed for.
