Though the F.I.R. has been challenged, but at the time when the matter is called upon, learned A.G.A. points out that statement of victim (petitioner no.2) has been recorded who has supported the prosecution case and has alleged that she was subjected to rape. Sections 376 I.P.C. and 3/4 of The Protection of Children From Sexual Offences Act have also been added. Faced with above observation, learned counsel for the petitioners comes with prayer to withdraw the writ petition with the liberty to the petitioner to seek appropriate remedy available to him under Code of Criminal Procedure.
