[Civil Misc. Recall Application No. 01 of 2023] Heard. Cause shown sufficient. Application is allowed. The order dated 09.10.2023 passed by this Court is hereby recalled. [Order on Contempt Application] The writ Court on 12.09.2022 in Writ-A No. 14166 of 2022 passed the following order; "Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. By means of this petition, the petitioner has prayed following reliefs:- "(i) Issue a writ, order or direction in the nature of mandamus directing the respondents to extend the benefit of making entry of appointment date

25.02.1991 and stabilization date 25.02.1993 in the Service-Book of the petitioner as said benefit has been given to similarly situated employees Pramod Kumar Yadav and Gyanendra Kumar Shukla by order dated

04.08.2022 passed by respondent no.2 and also provide 3rd A.C.P. to the petitioner due in the year 2017 within specified period.

(ii) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to decide application dated 11.08.2022 moved by petitioner (Annexure no.8 to the writ petition)." Learned counsel for the petitioner has confined his prayer for disposal of the petitioner's representation dated 11.08.2022, which is contained in Annexure No.8 to the writ petition and the same is still pending as per learned counsel for the petitioner. Learned counsel for the opposite parties has no objection if direction for disposal of the representation is issued. Therefore, without entering into merits of the issue, opposite party no.2 i.e. Inspector General, Registration, U.P., Prayagraj is hereby directed to decide the representation of the petitioner dated 11.08.2022, which is contained in Annexure No.8 to the writ petition, strictly in accordance with law, by speaking and reasoned order, with expedition, say within a period of eight weeks from the date of production of certified copy of this order and thereafter communicate the decision thereof to the petitioner forthwith. In the aforesaid terms, the writ petition is disposed of finally." From perusal of the order of writ Court it is clear that only direction was issued to the opposite party to decide the representation of the applicant. Today a compliance affidavit has been filed on behalf of the opposite party wherein it has been stated that representation of the applicant has been decided on 23.05.2023, copy of which has been brought on record as annexure No. 1 to the compliance affidavit. As the order of writ Court has been complied by the opposite party, no case for contempt is made out. Contempt application stands dismissed. Contempt notice stands discharged. File consign to record.
