¶1Case of the petitioner is that he surrendered his land to Noida in pursuance of sale-deed dated 09.09.2005. It contains a stipulation to the effect that 10% developed land would be given to the petitioner and for the said purpose 10% compensation amount was retained by the Noida. Now only 5% developed land has been given to the petitioner. It is refusing to hand over another 5% of developed land despite their being a specific agreement between the parties in this regard.

¶2Learned counsel appearing on behalf of respondent No. 3 states that claim of the petitioner will be considered in accordance with law.

¶3Accordingly, without expressing any opinion on merits, the petition is disposed of with a direction to respondent No. 3 to pass a speaking order in respect of claim of the petitioner within a period of eight weeks from the date of communication of the instant order along with a fresh representation.
