Judgment

Court No. - 46 Case :- CONTEMPT APPLICATION (CRIMINAL) No. - 2 of 2023 Applicant :- In Re Opposite Party :- Shri Ravindra Kumar Sharma And 2 Others Counsel for Applicant :- Suo Moto,Sudhir Mehrotra Counsel for Opposite Party :- Uma Nath Pandey Hon'ble Ashwani Kumar Mishra,J. Hon'ble Syed Aftab Husain Rizvi,J. This contempt petition has been entertained on a reference made by the Presiding Officer concerned, on the ground that a press conference was convened by the contemnor in which certain objectionable comments were made by the contemnor against the Presiding Officer concerned. The contemnor has filed a detailed reply stating that neither any such press conference was convened nor he has made any derogatory statement against the Presiding Officer concerned. Records reveal that a direction was issued by the Administrative Judge of the district concerned for an inquiry to be held by the District Judge on the question, as to whether any such press conference was convened within the premises of the District Court, as was alleged by the Presiding Officer. The District Judge, Bulandshahr has submitted a report on 02.12.2022, clearly stating that there is no evidence to show that any such press conference was convened by the contemnor or any such statement was made by him. We have, otherwise, summoned the original records of the Court concerned and have perused the circumstances in which the contemnor submitted his resignation on the ground that the Presiding Officer had denied him a reasonable opportunity to make his submissions on behalf of the State. We do not deem it necessary to make any comments on the grievance of the contemnor with regard to proceedings of Sessions Trial No.438 of 2017. However, in the facts of the case and also in view of the report of the District Judge, as per which no such press conference was held by the contemnor-opposite party, the proceedings of contempt are dropped/consigned to records. Original records shall be returned to the Court concerned. Order Date :- 7.11.2023 SP/- High Court of Judicature at Allahabad
