The present transfer application has been filed to transfer the Complaint Case No. 443 of 2022, under Section 376 IPC, pending in the Court of Additional Civil Judge (S.D.) Court No.2/Additional Chief Judicial Magistrate, Rampur. Learned counsel for the applicant submits that the opposite party no.2 in the above noted complaint case, which has been filed by the opposite party No.2 alleging with the allegation of offence punishable under Section 376 of IPC. Learned counsel for the applicant fairly submits that the cognizance order has not been passed till today. Applicant is serving in B.S.F and posted at Murshidabad, Kolkata and his life in danger to attain the court in District Rampur. It is further submitted that the opposite party No.2 pressurized to perform the marriage with him. In view of the facts and circumstances, the present transfer application deserves no merit, and is liable to be dismissed. The present transfer application is dismissed.
