¶1Heard Shri Abhishek Bhushan, learned counsel for the revisionist and perused the record.

¶2The present revision has been filed challenging the order dated

06.10.2023 passed by Additional District Judge (Court No.6), Varanasi in S.C.C. Suit No.24 of 2017 (Shahnawaz Khan Vs. Farmaan Ilahi) by which application filed by the revisionist under Order 7 Rule 11 of the CPC was rejected.

¶3It is argued by counsel for the revisionist that while rejecting the aforesaid application various findings were wholly illegally recorded against the revisionist.

¶4After some arguments, a prayer has been made by counsel for the revisionist to dismiss present revision but the findings recorded by the court below in the order impugned be not taken against him in the pending suit.

¶5In this view of the matter, without interfering with the order, which is under challenged in the present revision, the court below before whom aforesaid suit is pending is directed to decide the same expeditiously. It is made clear that while deciding the matter the court below will not take into consideration the findings recorded by the court below vide its order dated 06.10.2023.
