Court No. - 34 Case :- WRIT - A No. - 18641 of 2023 Petitioner :- Anup Singh Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Kameshwar Chaubey,Amit Singh Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. The petitioner who is complainant wants enquiry / investigation to be conducted by the department concerned, relating to appointment of respondent no. 2 . Learned Standing Counsel submits that third party rights cannot be agitated in service matter. It is a pure contract of employment between employer and employee, inasmuch as, public interest litigation is not entertained in service matter. Prima facie, preliminary objection raised by learned Standing Counsel appears to have substance. Learned counsel for the petitioner could not dispute the above during the argument, as he had neither any stake in the matter, nor was applicant against post on which respondent no. 2 got appointed. At this stage, Sri Kameshwar Chaubey, learned counsel for the petitioner submits that the petitioner may be dismissed as withdrawn. Petition is accordingly dismissed as withdrawn without any further liberty. Order Date :- 7.11.2023 Sanjeev High Court of Judicature at Allahabad
