¶1The dispute raised by petitioners that executor of power of attorney, who is allegedly living in Pakistan has died. However, admittedly till date initial burden to substantiate aforesaid fact has not been discharged by petitioners, therefore, their objection was rejected by Consolidation Authorities, which does not warrant any interference.

¶2Learned counsel for petitioners fairly submits that since matter is still pending before Deputy Director of Consolidation, therefore, a liberty may be given to petitioners that in case they come up with any documentary proof in support of their claim, they may have liberty to place before concerned authority to take note of.

¶3In aforesaid circumstances, without interfering with impugned order, this writ petition is disposed of with liberty, as prayed for. Order Date :- 8.11.2023 AK High Court of Judicature at Allahabad
