¶1Heard learned counsel for the petitioner.

¶2This petition has been filed seeking the following relief: "a. issue an order or direction to direct the Civil Judge (Senior Division), Hathras, District Hathras to decide the original suit No.320 of 2020 (Hanuman Prasad Vs. Ritu Upadhyay) within stipulated period fix by this Hon'ble Court."

¶3It appears that the original suit seeking cancellation of the sale deed or in the alternative to grant possession of the suit property was filed by the plaintiff-petitioner on 24.11.2020. It is stated that on 24.12.2020, the defendants had appeared and the written statement was filed on 7.9.2022, but the issues are yet to be framed.

¶4Under the circumstances, it is for the petitioner to move an appropriate application before the trial court for expeditious framing of the issues and if such an application is filed, the trial court would consider the same expeditiously.
