¶1Heard Sri Roopesh Kumar Nigam, learned counsel for the petitioner and Sri Anjani Kumar Chaurasiya, learned Standing counsel appearing on behalf of respondent nos. 1 to 3 as well as Sri Bhupendra Kumar Tripathi, learned counsel for respondent no.

¶2Present petition has been filed seeking a direction in the nature of mandamus to be issued in favour of the respondents to restrain the respondent no.5 not interfere in the peaceful possession of petitioner's khata no.00093, Gata No.15, area 0.2250, situated at Village Devai, Tehsil Mugalsarai, District Chandauli.

¶3Today when the matter has been taken up, learned Standing Counsel came up with the specific instructions which is taken on record through which it has been transpired that plot no.109 which is recorded as Rajbaha in the revenue records, is adjacent to the plot of petitioner, whereupon construction of water tank was going on but construction of the same has been stopped and the plot of petitioner is intact.

¶4In view thereof, there is hardly any cause of action arises in favour of the petitioner to pursue the instant petition.
