¶1Heard Shri Ram Chandra Kushwaha, learned counsel for the petitioner and Shri Rajesh Kumar Tiwari, learned Additional Chief Standing Counsel on behalf of respondent nos.1 to 4 as well as Shri Kaushal Kishore Mani appearing on behalf of respondent no.5.
¶2Present petition has been filed seeking a writ, order or direction in the nature of mandamus directing / commanding to the respondent authorities to make a construction of water tank under Jal Jeevan Mission in another place/ arazi in place of arazi no.384-M, area 0.0640 hectare which is recorded in revenue record as compost pits for public use which is situated in village Umri Khurd, Pargana & Tehsil Rampur Maniharan, District Saharanpur.
¶3Today, when the matter has been taken up, learned Additional Chief Standing Counsel came up with the specific instructions which is taken on record, through which, it has been transpired that the respondent authorities to make a construction of water tank under Jal Jeevan Mission in another place/ arazi in place of arazi no.384-M, area 0.0640 hectare, which is recorded in the revenue record as compost pits for public use, which is situated in village Umri Khurd, Pargana & Tehsil Rampur Maniharan, District Saharanpur. The villagers of the village with the consent of the Gram Pradhan has given an application before the Sub Divisional Magistrate for construction of water tank under Jal Jeevan Mission and the soil testing is done for public use.
¶4In view thereof, there is hardly any cause of action arises in favour of the petitioner to pursue the instant petition.
¶5Accordingly, the present petition stands, disposed of.
