¶1Heard learned counsel for the petitioner and Ms. Subhra Singh, learned Standing Counsel for the State-respondents.

¶2Ms. Subhra Singh, learned Standing Counsel has placed the detailed instruction, the same is taken on record.

¶3The petitioner is aggrieved with non-completion of the investigation of Case Crime No. 222 of 2021 under sections 419, 420, 467, 468, 471 IPC registered on 01.08.2021 at P.S.- Gabhana, District-Aligarh.

¶4Learned Standing Counsel, on the instructions, states that the investigation is already finalised in the matter. Initially, the matter was investigated by the concerned Sub-Inspector, wherein, he had not found any complicity to the accused person and thereafter, the final report under Section 173(2) CrPC was submitted. Thereafter, the complaint was received by the Inspector General of Police, Aligarh on 25.01.2023 and the matter was transferred for further investigation at District-Hathras. Even thereafter, the allegations were not found to be correct and final report was also transmitted to the competent authority.

¶5Considering the factual aspect of the matter, on the complaint of the petitioner, the matter was transferred to the District-Hathras and thereafter, the final report had already submitted. We are not inclined to proceed further in the matter. It is left open to the petitioner to invoke the remedy as available in law.
