¶1Heard Sri Shashank Sharma, learned counsel for the petitioner and Sri Satyendra Bhushan Dubey, learned Standing counsel appearing on behalf of respondent nos. 1 to 4 as well as Sri Bhupendra Kumar Tripathi, learned counsel for respondent no. 5.

¶2Present petition has been filed seeking a direction in the nature of mandamus to be issued in favour of the respondents no. 2 and 3 take immediate steps for restraining the respondent nos.5 and 6 to establish water tank over Arazi No.482 which is recorded as Khalihan, situated at Village Sonahita, Tehsil Machhalishahar, District Jaunpur.

¶3Today when the matter has been taken up, learned Standing Counsel came up with the specific instructions which is taken on record through which it has been transpired that for the purposes of construction of water tank, proceeding of exchange has been initiated by the revenue authorities from gata nos.1209, 1037 and 28 which are recorded as Navin Parti in the revenue record and construction of water tank has yet not been started over Gata No.482.

¶4In view thereof, there is hardly any cause of action arises in favour of the petitioner to pursue the instant petition.
