Judgment
Court No. - 44 Case :- CRIMINAL MISC. BAIL CANCELLATION APPLICATION No. - 728 of 2023 Applicant :- Nirmala Opposite Party :- State Of U.P. And 3 Others Counsel for Applicant :- Rajesh Kumar Bind Counsel for Opposite Party :- G.A. Hon'ble Pankaj Bhatia,J.
¶1Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.
¶2The present application has been filed seeking cancellation of bail granted by this Court vide order dated 21.09.2023.
¶3The contention of the Counsel for the applicant is that while granting bail, the Court was impressed by the allegation that the FIR was lodged after some delay, which is an incorrect fact and the applicant had informed about the offences much in advance, as is clear from the documents contained at page 35 of the paper book.
¶4Learned A.G.A. vehemently opposed the bail prayer.
¶5Considering the fact that there is no averment that after the grant of bail, liberty of the bail has been misused by the accused. Accordingly, the bail cancellation application is rejected. Order Date :- 8.11.2023 akverma High Court of Judicature at Allahabad
