¶1Heard learned counsel for the petitioner and learned Standing Counsel for the State respondent no.1.

¶2Notice need not be issued to the private respondent nos.2 to 5, in view of the order proposed to be passed.

¶3The petitioner is before this Court with request to issue direction to the second respondent, President, District Consumer Disputes Redressal Commission, Gorakhpur to decide Consumer Complaint No.12 of 2017 (Ishrat Hussain Khan vs. General Manager, Smart Wheels Pvt. Ltd., Gorakhpur & others) within stipulated time.

¶4No useful purpose would be served in keeping the writ petition pending consideration.

¶5In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the second respondent to decide the aforesaid case after giving opportunity of hearing to all the stake holders, as expeditiously as possible and preferably within a period of three months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of exemplary cost.
