¶1Matter taken up in the revised list. No one appears on behalf of the appellants to press this appeal despite there are two learned counsels appearing on behalf of the appellants. Sri Ajay Singh, learned A.G.A-I for the State is present.

¶2The present appeal has been preferred by the appellants against the judgment and order dated 26.8.1982 passed by IIIrd Addl. District and Sessions Judge, Bareilly in S.T. No.266 of 1981.

¶3The appeal with regards to appellant no.1 Mehandi Hasan has already been abated vide order dated 11.9.2023.

¶4As per the office report dated 4.10.2023, a report of C.J.M., Bareilly dated 25.9.2023 has been received stating therein that the appellant no.2 Abdul Hasan has died. The said report has been sent after due inquiry.

¶5This Court has perused the said report which states that the accused-appellant no.1 Abdul Hasan has died.

¶6In view of the above, the appeal stands abated.
